Welcome to Zenith Xperience! These Terms of Service (“Terms”) govern your access to and use of the products, services, websites, and platforms operated by Zenith Xperience Pvt. Ltd. (“Zenith Xperience,” “we,” “our,” or “us”), including but not limited to our SaaS solutions, bespoke software products, and extended reality (XR) experiences.

By accessing or using any of our services, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree, you must discontinue use immediately.

Zenith Xperience provides:

• Extended Reality (XR) solutions including Virtual Reality (VR), Augmented Reality (AR), and Mixed Reality (MR) experiences.

Our services may be delivered under the Zenith Xperience brand or under the branding of specific partner platforms. Each platform may have its own additional terms, privacy policy, and usage guidelines.

Eligibility

You may use our services only if:

• You are at least 18 years old, or have the consent of a parent/guardian if applicable to the platform.
• You are legally able to enter into binding contracts.
• You comply with all applicable laws and these Terms.

Some services may be restricted to certain regions or audiences, as determined by the respective platform.

Account Registration & Security

Certain services require you to register for an account. You agree to:

• Provide accurate and up-to-date information.
• Maintain the confidentiality of your login credentials.
• Be responsible for all activities under your account.
• Notify us immediately of any unauthorized use.

User-Generated Content

Some Zenith Xperience platforms may allow you to upload, create, or share content.

• Ownership: Ownership of such content is governed by the Terms of Service of the respective platform on which the content is created or hosted.
• Licence to Us: By using our platforms, you grant Zenith Xperience and its affiliates a non-exclusive, worldwide licence to host, store, and process your content solely for the purpose of operating the platform and delivering services to you.
• You must ensure that your content does not infringe any laws or third-party rights.

Prohibited Activities

When using our services, you must not:

• Engage in unlawful, fraudulent, or harmful activities.
• Upload or distribute viruses, malware, or harmful code.
• Harass, abuse, or threaten others.
• Violate intellectual property rights of others.

Payments, Billing, and Refunds

For paid services:

• Fees, billing cycles, and payment terms will be specified in the relevant service agreement or platform subscription details.
• Payments are non-refundable unless otherwise stated in the respective platform’s terms or required by law.

AR/VR Safety Disclaimer

Use of AR/VR/MR technologies involves inherent risks, including but not limited to:

• Motion sickness, dizziness, or disorientation
• Eye strain or headaches
• Physical injury from tripping, falling, or colliding with objects in your environment

You are responsible for ensuring a safe physical environment when using our XR experiences. We recommend:

• Clearing your play area of obstacles
• Taking regular breaks
• Avoiding use if you are tired, dizzy, ill, or under the influence of substances
• Following all manufacturer safety guidelines for your devices

Zenith Xperience is not responsible for any injury, property damage, or other harm resulting from the misuse of XR technologies.

Third-Party Services

Our platforms may integrate third-party tools or services. We are not responsible for the content, policies, or practices of such third parties.

Termination

We may suspend or terminate your account or access to services at our sole discretion if you violate these Terms or applicable laws. Upon termination, you must stop using our services immediately.

Disclaimers & Limitation of Liability

Our services are provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law:

• We disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.
• We will not be liable for any indirect, incidental, or consequential damages arising from your use of our services.

Indemnification

You agree to indemnify and hold harmless Zenith Xperience, its directors, employees, and partners from any claims, damages, or expenses arising from:

• Your violation of these Terms
• Your misuse of the services
• Your infringement of third-party rights

Governing Law & Dispute Resolution

These Terms shall be governed by and construed under the laws of Sri Lanka.
Any disputes will be subject to the exclusive jurisdiction of the courts of Sri Lanka.
